Commission Terms of Service

Hey! I’m Venkaris, a digital artist based in France. These terms explain how my commission process works, what you can expect from me, and what I expect from you. I wrote this to be as clear as possible so there are no surprises.
By submitting a commission request, you agree to these terms.

Note:Â Nothing in these terms takes away your mandatory legal rights under your local law.
1. Who This Applies To
Artist:Â Venkaris (Mark Abramenko), micro-entrepreneur registered in France, SIRET 98920338500012.
You:Â The person commissioning the artwork.
Artwork:Â The custom digital art described in your invoice.
To commission me you must be 18 or older. I may ask for proof of age at any time. If I find out you are under 18, I will cancel the commission and give you a full refund. However, if you deliberately provided false confirmation of your age to obtain the commission, you are not entitled to a refund. Lying to enter a contract voids your consumer protections.
2. The Commission Process
Official communication channel
All binding steps of the commission happen over email. This includes the invoice, sketch approvals, stage confirmations, and file delivery.
We can chat casually on Discord, Telegram, or other platforms, but nothing said there is contractually binding. If you request a change or give approval on Discord, I will ask you to confirm it by email before I act on it. This protects both of us.
Step 1: Submit Your Request
Fill out the form at venkaris.com. Give me as much detail as you can, including reference images if you have them. The more I know, the better.
Step 2: I Review and Reply
I will get back to you within 3 to 5 business days. I will either accept your request or let you know it is not a good fit, or that I am fully booked.
If I accept, I will send you a personalized invoice with:
- A description of the artwork I will create
- The estimated timeline
- The number of revisions included
- The file format I will deliver
- The license terms
Step 3: Payment
I require full payment upfront before I start any work. Payment is due within 7 days of the invoice date.
Once you pay, that is the moment our contract starts. See Section 4 for what happens if you cancel.
Step 4: Sketch
I will create 1 to 2 rough sketches based on what we agreed. This is the best time to give feedback on the pose, composition, and overall direction.
This is also where you can request small changes. Big changes that alter the whole concept may cost extra and need a timeline adjustment. We will agree on that in writing before I continue.
Step 5: Remaining Stages
After sketch approval I will move through these stages:
- Linework
- Shading
- Coloring
- Final rendering and finishing touches
I will send you an update at each stage. See Section 5 for revision rules.
Step 6: Delivery
Once the artwork is done I will send you a download link to your PNG file. I archive all finished work so I can always re-send your file if you need it later.
3. Payment
I accept payment via PayPal, Stripe, or bank transfer (SEPA), in euros (EUR).
All prices are in euros. If you pay via PayPal or Stripe, they handle currency conversion and any conversion fees are yours. For bank transfers, make sure the full euro amount arrives after all bank fees.

4. Cancellations and Refunds
If you cancel before I start sketching
Full refund, no questions asked.
If you cancel after I start sketching
I will keep the portion of the fee that matches the work I have already done. The rest gets refunded to you.
I calculate this using the stage breakdown below. These percentages reflect the actual time each stage takes based on my documented process:

Example:Â You paid 397 EUR for a Full Illustration. I finished the sketch and linework (45% of the work). You cancel. I keep 45% of 397 EUR = 178.65 EUR. You get back 218.35 EUR.
If you go silent for 30 days
If I do not hear from you for 30 consecutive days at any point where I am waiting for your input, I will consider the commission abandoned. I will close it and keep all payments. No exceptions.
If I cancel
If I have to cancel for any reason, I will refund everything you paid, including any transaction fees.
5. EU Right of Withdrawal
If you are an EU consumer, you have the right to withdraw from this contract within 14 days of paying the invoice, without giving a reason.
However:Â By paying the invoice, you are explicitly asking me to start work right away, and you acknowledge that once I have fully delivered the completed artwork, your right of withdrawal is gone.
This means:
- If you withdraw before I start sketching: full refund.
- If you withdraw after I have started but before delivery: you pay for the portion of work already completed (using the stage percentages in Section 4). I refund the rest.
- If you withdraw after I deliver the final artwork: no refund. The withdrawal right is fully extinguished at delivery.
If you did not give consent for immediate start (which would be unusual since payment of the invoice counts as that consent), you would owe nothing for work done. This is why the consent language on the invoice matters. By paying, you are confirming you saw it and agreed to it.
This does not affect your other statutory rights under your local law.
6. Revisions
Small revisions (2 rounds included)
Small changes that do not alter the core composition:
- Color adjustments
- Line refinements
- Minor detail tweaks
Big revisions (may cost extra)
Changes that significantly alter what we agreed on:
- Changing a character’s pose completely
- Redesigning the background
- Adding new characters or elements not discussed before
If you ask for a big revision, I will give you a price and time estimate within 5 business days. I will only continue once we agree in writing.
My mistakes (always free)
If the final artwork does not match the approved sketch, has rendering errors, or the file is corrupted, I will fix it at no charge. This does not count as a revision round. You must tell me within 30 days of delivery.
If you do not reply
If I am waiting for your feedback and you do not reply within 10 business days, I will pause the project. If you do not reply for 30 consecutive days, Section 4 (abandonment) applies.
7. What You Can Do With the Artwork
Personal use (included)
Every commission comes with a personal use license. You can:
- Share it on social media or personal websites
- Print it for personal use
- Use it as an avatar or digital background on regular (non-blockchain) platforms
Commercial use (costs extra)
If you want to use the artwork to make money or promote a business (merchandise, book covers, ads, branding), you need a commercial license. This costs an additional 100% of the base commission fee.
You can add it upfront or upgrade later. The upgrade price is always based on the original base fee, no matter what my rates are at the time.
With a commercial license, you can crop or resize the artwork for layout purposes. You cannot otherwise modify it or make derivative works without my written permission. If cropping removes my signature, attribution is required as described in the Attribution section below.
Attribution
I always sign my work. If you share the artwork with my signature visible, no credit is required (though it is always appreciated).
If you crop or edit the artwork in a way that removes my signature, you must credit “Art by Venkaris” when sharing it publicly. This is a binding condition of your license, not a suggestion.
What you cannot do
Without my written permission, you cannot:
- Resell or sublicense the artwork
- Submit it to AI training datasets or platforms
- Use it as an NFT, tokenized asset, or any blockchain-based financial product
- Use it for any cryptocurrency or Web3 project
- Use it for political campaigns
Note: using the artwork as a regular profile picture on a normal social media platform is fine under the personal use license.
8. Fan Art
If you are commissioning fan art of a character owned by someone else, note that I am creating a derivative work of third-party IP. A personal use license is fine for fan art in most cases. However, a commercial license for fan art may not be possible or may carry additional legal risk depending on the IP owner. We will discuss this during the review stage if it applies to your request.
9. Copyright
I keep the copyright to all artwork I create. This applies to both personal and commercial licenses. What you are buying is permission to use the artwork in specific ways. It is not ownership of the artwork itself. No license transfers copyright to you.
10. File Delivery
You will receive a high-resolution PNG file (300 dpi, sRGB).
I do not provide layered files (PSD or similar) under any circumstances.
I archive all finished artwork indefinitely. If you ever lose your download link, contact me and I will re-send it.
Let me know right away if your file arrives corrupted or incomplete.
Rush orders
A rush order is one where you explicitly request delivery within a specific deadline. If you request delivery in less than 4 weeks from the start of the project, a rush fee applies. Less than 2 weeks requires a significant additional charge. These will be specified in your invoice.
If I simply finish the work faster than expected without a rush deadline having been requested, no rush fee applies.
11. Confidentiality and Portfolio Use
By default, I will:
- Share the finished artwork in my portfolio and on social media
- Record the creation process (time-lapses, etc.) for educational or promotional use, with any personal info removed
Free temporary embargo (30 days)
If you need the artwork kept private for a short time (for example, it is a gift), just ask. I will hold off on sharing it for 30 days at no extra cost.
Privacy package (permanent confidentiality)
If you need complete and permanent confidentiality, I offer a Privacy Package for an additional 40% of the base fee, agreed before the project starts. This includes:
- No portfolio or social media use of your artwork
- No process recordings
- No public mention that you commissioned me
- Full confidentiality of our working relationship
The only exception is if I am required to disclose something by law or court order.
Your information
I will keep all reference materials, personal details, and unique concepts you share with me confidential. I will not use your unique concepts for other clients.
12. Quality and My Responsibility
The finished artwork will match the approved sketch and the invoice description. Small color variations due to screen settings or printing differences are normal and are not defects.
I am not responsible for:
- Outages or issues with PayPal, Stripe, or download platforms
- Your dissatisfaction with the final result if it matches what we agreed on
If the artwork has an objective error (does not match the approved sketch, has a rendering mistake, or the file is corrupted), tell me within 30 days of delivery and I will fix it for free.
I only issue refunds in cases of complete non-delivery or if the artwork looks nothing like what was commissioned. I do not refund for personal taste changes or minor issues I can correct.
13. Chargebacks
If you file a chargeback after I deliver your artwork, that is a breach of this contract. I will submit the invoice, payment record, delivery confirmation, and our full communication history to the payment processor to contest it. I reserve the right to recover any fees or losses caused by an unjustified chargeback.
14. Force Majeure
If something completely outside my control prevents me from working (natural disaster, major infrastructure failure, etc.), I will let you know within 14 days and we will pause the project.
In the case of personal illness, I may pause the project for up to 4 weeks. If I am unable to complete your commission for more than 60 cumulative days due to any force majeure event, I will give you a full refund.
15. Dispute Resolution and Governing Law
If something goes wrong, please contact me first. I want to sort it out directly.
These terms are governed by French law.
If you are an EU consumer, you can also go through your local small claims court or the EU Online Dispute Resolution platform.
For non-EU clients, any unresolved disputes will be handled in French courts under French law.
If any part of these terms is found invalid by a court, that part alone is affected. The rest of the terms continue to apply as normal. This is a standard clause that prevents one problematic line from voiding the entire agreement.
16. Data and Privacy
I collect your name, email, and commission details only to fulfill our agreement.
All official commission steps happen over email. Those email exchanges are part of my business records and I keep them for legal and dispute resolution purposes. Casual conversations on Discord, Telegram, or other platforms are not part of my official records and are not subject to these retention rules.
After 2 years from the completion of your commission, I will remove your personal contact details (name, email address, social handles) from my active systems. I am not required to delete invoice records, as French law requires me to keep financial records for 10 years. I am also not required to delete the artwork itself, which remains my intellectual property.
The artwork files stay in my archive permanently as my intellectual property.
You have the right to access, correct, or request deletion of your personal data. Visit venkaris.com/privacy-statement-eu to do that.
17. Changes to These Terms
The terms in effect when I send your invoice are the ones that apply to your commission. Future changes only apply to new orders.
By paying the invoice, you confirm that you have read and agreed to these terms.
