Commission terms of service

Last updated: March 29, 2026

Hey! I’m Venkaris, a digital artist based in France. These terms explain how my commission process works, what you can expect from me, and what I expect from you. I wrote this to be as clear as possible so there are no surprises.

By submitting a commission request, you agree to these terms.

Quick summary

Read this at minimum. The full terms below have all the details, but this table covers the most important points.

TopicWhat it means
How to startFill out the form at venkaris.com. I will reply within 3 to 5 business days.
PaymentFull payment upfront before I start any work.
Can you cancel?Yes, before I start sketching you get a full refund. After I start, refunds follow fixed stage checkpoints (started and draft delivered).
EU withdrawal rightEU clients have a 14-day withdrawal right. If work has started, you get back the portion I have not done yet.
Revisions2 rounds of small changes included. Big changes may cost extra.
No reply for 30 daysI will send a warning at day 23. If you still do not reply by day 30, I close the commission. You can claim the refund on unworked portions at any time.
What you getA high-resolution PNG file. No layered files ever.
LicensePersonal use is included. Commercial use costs extra.
AttributionIf you crop out my signature, you must credit me when sharing.
CopyrightI keep the copyright to everything I create.
Governing lawFrench law. EU clients keep their local consumer rights.
Add-onsAdditional characters are a flat fee per character. Background type adjusts the price up or down. Rush fee applies to the subtotal. Commercial license and privacy package are calculated from the flat base tier price only.

Nothing in these terms takes away your mandatory legal rights under your local law.

1. Who this applies to

Artist: Venkaris (Mark Abramenko), micro-entrepreneur registered in France, SIRET 98920338500020.

You: The person commissioning the artwork.

Artwork: The custom digital art described in your invoice.

To commission me you must be 18 or older. I may ask for proof of age at any time. If I find out you are under 18, I will cancel the commission and give you a full refund. If you deliberately provided false confirmation of your age to obtain the commission, you are not entitled to a refund.

2. The commission process

All binding steps of the commission happen over email. This includes the invoice, sketch approvals, stage confirmations, and file delivery.

We can chat casually on Discord, Telegram, or other platforms, but nothing said there is contractually binding. If you request a change or give approval on Discord, I will ask you to confirm it by email before I act on it.

Step 1: Submit your request Fill out the form at venkaris.com. Give me as much detail as you can, including reference images if you have them. The more I know, the better.

Step 2: I review and reply I will get back to you within 3 to 5 business days. I will either accept your request, let you know it is not a good fit, or let you know I am fully booked.

If I accept, I will send you a personalized invoice with a description of what I will create, the estimated timeline, the number of revisions included, the file format, and the license terms.

Step 3: Payment Full payment upfront before I start any work. Payment is due within 7 days of the invoice date. Once you pay, that is when the contract starts.

Step 4: Sketch I will create 1 to 2 rough sketches based on what we agreed. This is the best time to give feedback on the pose, composition, and overall direction. Big changes that alter the whole concept may cost extra and need a timeline adjustment. We will agree on that in writing before I continue.

Step 5: Remaining stages After sketch approval I will move through linework, shading, coloring, and final rendering. I will send you an update at each stage.

Step 6: Delivery Once the artwork is done I will send you a download link to your PNG file. I archive all finished work so I can always re-send your file if you need it later.

3. Payment

I accept payment via PayPal, Stripe, or bank transfer (SEPA), in euros (EUR).

All prices are in euros. If you pay via PayPal or Stripe, they handle currency conversion and any conversion fees are yours. For bank transfers, make sure the full euro amount arrives after all bank fees.

TVA non applicable, art. 293 B du CGI.

Base prices

The base price covers one character with a standard background for the chosen tier.

TierRegular priceLaunch price
Headshot€147€117
Full Illustration€497€397

The launch price is a 20% discount. I track launch slots manually: 3 discounted slots for Headshot and 3 discounted slots for Full Illustration. Once a tier’s slots are filled, new requests for that tier are invoiced at the regular price. The other tier is not affected.

Add-ons

Apply in this order. Steps 1 through 3 build the running subtotal. The rush fee applies to that subtotal. Commercial and privacy are always calculated from the flat base tier price only, regardless of what else is in the order.

Step 1 – Additional characters

Flat rate per character beyond the first. The form does not ask for the scope of each character individually – that is a composition decision made at the sketch stage.

TierPer additional character
Full Illustration+€100
Headshot+€60

Step 2 – Background modifier

Background typeFull IllustrationHeadshot
Simple / flat color−€100included
Stylized / abstract−€80+€20
Full scene / environmentincluded+€80

Step 3 – Extra revisions

Two rounds are included in the base price. Each additional round beyond that is +€25.

Step 4 – Rush fee

Applied to the running subtotal after steps 1 through 3.

DeadlineFee
Delivery in less than 4 weeks from project start+25% of subtotal
Delivery in less than 2 weeks from project start+50% of subtotal

Step 5 – Commercial license

+100% of the flat base tier price. Not applied to the subtotal.

Step 6 – Privacy package

+40% of the flat base tier price. Not applied to the subtotal.

Pricing example

Full Illustration, launch price, 2 characters, simple background, rush delivery in 3 weeks, commercial license:

Base (launch)€397
Second character+€100 → €497
Simple background−€100 → €397
Rush 25%+€99 → €496
Commercial license (100% of €397 base)+€397
Total€893

Your invoice will always show this breakdown line by line before you pay. The form shows a live estimate as you fill it out. Complex briefs may be adjusted after review – if I adjust anything, I will explain why before you pay.

Rush fee and client delays

The rush fee is not refundable if your replies cause the deadline to be missed. It covers prioritization of your slot regardless of whether the deadline is met. If your replies are consistently delayed and the deadline becomes unachievable, I will let you know in writing and we will agree on a revised timeline. The rush fee stays on the invoice.

If you file a chargeback after I deliver your artwork, that is a breach of this contract. I will submit the invoice, payment record, delivery confirmation, and our full communication history to the payment processor to contest it. I reserve the right to recover any fees or losses caused by an unjustified chargeback.

4. Cancellations and refunds

If you cancel before I start sketching Full refund, no questions asked.

If you cancel after I start sketching I will keep the portion of the fee that matches the work already done. The rest gets refunded to you.

To avoid subjective judgments about how “complete” a stage is, I use fixed stage checkpoints.

For each stage:

  • 50% of that stage value is earned when the stage is started.
  • The other 50% is earned when I deliver that stage’s draft/update for your review.

Any later stages not started are fully refundable.

StageStage valueEarned at stage startEarned at draft/update delivery
Sketch30%15%+15%
Linework15%7.5%+7.5%
Shading40%20%+20%
Coloring5%2.5%+2.5%
Final rendering10%5%+5%

Example: You paid €397 for a Full Illustration. I started sketching but had not yet delivered the sketch draft. You cancel. I keep 15% of €397 = €59.55. You get back €337.45.

If you go silent If I do not hear from you for 23 consecutive days at any point where I am waiting for your input, I will send you a reminder. If you do not reply within 7 more days (30 days total), I will close the commission. I will keep the portion earned under the stage checkpoints above. You can contact me at any time to claim a refund on the unworked portion. There is no deadline on that claim.

If I cancel If I have to cancel for any reason, I will refund everything you paid, including any transaction fees.

EU right of withdrawal If you are an EU consumer, you have the right to withdraw from this contract within 14 days of paying the invoice, without giving a reason.

By checking the consent box in the commission form and paying the invoice, you confirm your request for work to begin immediately, and you acknowledge that once I have fully delivered the completed artwork, your right of withdrawal is gone.

  • If you withdraw before I start sketching: full refund.
  • If you withdraw after I have started but before delivery: you pay for the portion earned under the same stage checkpoints above. I refund the rest.
  • If you withdraw after I deliver the final artwork: no refund. The withdrawal right is fully extinguished at delivery.

This does not affect your other statutory rights under your local law.

5. Revisions

What is included Two rounds of revisions are included. Each round covers small changes that do not alter the core composition: color adjustments, line refinements, minor detail tweaks.

What costs extra Changes that significantly alter what we agreed on: changing the pose completely, redesigning the background, adding new characters or elements not discussed before. If you ask for a big revision, I will give you a price and timeline estimate within 5 business days. I will only continue once we agree in writing.

If I make a mistake If the finished artwork does not match the approved sketch, has a rendering error, or the file is corrupted, I will fix it at no charge. This does not count as a revision round. You have 30 days from delivery to flag it.

I do not refund if the final result matches what was approved at the sketch stage. If there is a correctable issue, I fix it. Refunds are only issued for complete non-delivery.

If you do not reply If I am waiting for your feedback and you do not reply within 10 business days, I will pause the project and push back your delivery estimate accordingly. If you paid a rush fee for a specific deadline and your replies are consistently delayed, I cannot guarantee that deadline. See Section 3 for what happens to the rush fee in that case. If you do not reply for 30 consecutive days, the abandonment terms in Section 4 apply.

6. License and what you can do with the artwork

Personal use (included) Every commission comes with a personal use license. You can share it on social media or personal websites, print it for personal use, and use it as an avatar or digital background on non-blockchain platforms.

Commercial use (costs extra) If you want to use the artwork to make money or promote a business (merchandise, book covers, ads, branding), you need a commercial license. This costs an additional 100% of the base tier price. You can add it upfront or upgrade later. The upgrade price is always based on the original base tier price, no matter what my rates are at the time.

With a commercial license, you can crop or resize the artwork for layout purposes. You cannot otherwise modify it or make derivative works without my written permission. If cropping removes my signature, attribution is required as described below.

Fan art If you are commissioning fan art of a character owned by someone else, I am creating a derivative work of third-party IP. A personal use license is fine for fan art in most cases. A commercial license may not be possible or may carry additional legal risk depending on the IP owner. We will discuss this during the review stage if it applies.

Attribution I always sign my work. If you share the artwork with my signature visible, no credit is required (though it is always appreciated). If you crop or edit the artwork in a way that removes my signature, you must credit “Art by Venkaris” when sharing it publicly. This is a binding condition of your license.

What you cannot do Without my written permission, you cannot resell or sublicense the artwork, submit it to AI training datasets or platforms, use it as an NFT or any blockchain-based product, use it for any cryptocurrency or Web3 project, or use it for political campaigns.

I keep the copyright to all artwork I create. This applies to both personal and commercial licenses. What you are buying is permission to use the artwork in specific ways, not ownership of the artwork itself.

8. File delivery

You will receive a high-resolution PNG file. My default canvas size is 4000×5000 or 5000×4000 pixels depending on the composition. If you have a specific resolution requirement, mention it in the form and we will discuss it.

I do not provide layered files (PSD or similar) under any circumstances.

I archive all finished artwork indefinitely. If you ever lose your download link, contact me and I will re-send it.

Rush orders A rush order is one where you explicitly request delivery within a specific deadline. Rush fees are listed in Section 3. If I finish faster than expected without a rush deadline having been requested, no rush fee applies.

9. Confidentiality and portfolio use

By default, I will share the finished artwork in my portfolio and on social media, and record the creation process for educational or promotional use. Note that speedpaints will show the character design. If this is a concern, the Privacy Package below covers it.

Free temporary embargo (up to 30 days) If you need the artwork kept private for a short time (for example, it is a gift), just ask. I will hold off on sharing it for up to 30 days at no extra cost.

Privacy package (permanent confidentiality) If you need complete and permanent confidentiality, I offer a Privacy Package for an additional 40% of the base tier price, agreed before the project starts. This includes no portfolio or social media use of your artwork, no process recordings, no public mention that you commissioned me, and full confidentiality of our working relationship. The only exception is if I am required to disclose something by law or court order.

10. Data and privacy

I collect your name, email, and commission details only to fulfill our agreement.

All official commission steps happen over email. Those exchanges are part of my business records and I keep them for legal and dispute resolution purposes. Casual conversations on Discord, Telegram, or other platforms are not part of my official records.

After 2 years from the completion of your commission, I will remove your personal contact details (name, email address, social handles) from my active systems. I am not required to delete invoice records, as French law requires me to keep financial records for 10 years. The artwork files stay in my archive permanently as my intellectual property.

You have the right to access, correct, or request deletion of your personal data. Visit venkaris.com/privacy-statement-eu to do that.

11. Dispute resolution and governing law

If something goes wrong, contact me first. I want to sort it out directly.

These terms are governed by French law. If you are an EU consumer, you can also go through your local small claims court or the EU Online Dispute Resolution platform. For non-EU clients, any unresolved disputes will be handled in French courts under French law.

If any part of these terms is found invalid by a court, that part alone is affected. The rest continue to apply. (This is standard severability language.)

12. Force majeure

If something completely outside my control prevents me from working (natural disaster, major infrastructure failure, etc.), I will let you know within 14 days and we will pause the project. In the case of personal illness, I may pause for up to 4 weeks. If I am unable to complete your commission for more than 60 cumulative days due to any force majeure event, I will give you a full refund.

13. Changes to these terms

The terms in effect when I send your invoice are the ones that apply to your commission. Future changes only apply to new orders.

By submitting a commission request, you confirm that you have read these terms. By paying the invoice, you confirm your agreement to them.

Looking forward to creating something with you!
